• Discover organizations and individuals aligned with their interests, skills, and career goals;
• Join career micro-communities (“pods”) to share knowledge and receive contextual guidance;
• Explore career pivots and opportunities across industries, geographies, and working styles.

Features and functionality may change over time. We will notify users of any material changes that affect their use of the Platform.

3. User Accounts

3.1 Account Registration

To access most features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@thekindsocialmediacompany.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

In keeping with oyster’s mission to foster a kind, collaborative, and authentic environment, you agree not to post content that:

• Is false, misleading, or deceptive;
• Is harassing, abusive, threatening, defamatory, or discriminatory;
• Infringes upon any intellectual property rights of a third party;
• Violates any applicable law or regulation;
• Contains spam, unsolicited advertising, or promotional materials;
• Includes personal or confidential information of others without their consent.

We reserve the right to remove any User Content that violates these standards at our sole discretion.

6. Platform Conduct and Community Standards

• Provide candid and genuine career advice when participating in 1:1 guidance conversations;
• Represent their career histories, skills, and experiences truthfully;
• Refrain from using the Platform for commercial solicitation, recruiting without consent, or any purpose inconsistent with career exploration and community building.

Users who earn “pearls” on their profile for giving career guidance are expected to uphold the highest standards of genuine, helpful engagement. Abuse of the pearl system, including fabricated or low-effort advice for the purpose of accumulating pearls, may result in account suspension.

7. Intellectual Property

All content, features, design elements, trademarks, and technology that make up the oyster Platform — excluding User Content — are owned by The Kind Social Media Company and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our express written permission.

8. Third-Party Links and Services

The Platform may contain links to third-party websites or services. These links are provided for your convenience only. oyster has no control over, and assumes no responsibility for, the content, privacy practices, or terms of any third-party sites. We encourage you to review the terms and privacy policies of any third-party services you visit.

The Platform is provided on an “as is” and “as available” basis. While we work hard to deliver a reliable and high-quality experience, oyster makes no warranties, express or implied, regarding:

• The outcomes of career decisions made based on connections or advice found through the Platform;

Career advice shared by other users reflects their personal experiences and opinions. oyster is not responsible for outcomes resulting from user-generated advice or connections made through the Platform.

10. Limitation of Liability

To the fullest extent permitted by applicable law, The Kind Social Media Company and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform. Our aggregate liability for any claim arising out of these Terms shall not exceed the greater of (a) USD $100 or (b) the amount you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Kind Social Media Company and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration in accordance with the rules of the American Arbitration Association.
